At WorldConnX, Inc., we value our customers and would like to make their Internet experience as enjoyable as possible. We strive to provide a service that will be beneficial to individuals and businesses. These policies are intended to make our service available to all our customers as consistently and efficiently as possible. Although WorldConnX does not consistently monitor your use, you are obligated to abide by these policies. These policies are part of your terms of service agreement, and violating them means we can take appropriate action to restrict or terminate your access to WorldConnX.
Please read the following agreement carefully. They explain the policies and rules related to use of WorldConnX Internet Service. By accessing the service, you are stating that you agree with WorldConnX, Inc. ("us", "we", "our" or "WorldConnX") and to the following Terms. "You" refers to you, the user, together with any company or other business entity you are representing. WorldConnX, Inc (we) agrees to provide the User (you) access to the worldwide Internet under the terms and conditions below:
A. Price and Payment- payment is due in advance for each month of service. Service will be billed around the 15th and due the 1st of each month. Access will be terminated if not paid by the 1st. An account is for one individual or a standalone business PC. If the account is connected to WorldConnX but not in use for 20 minutes, the connection may be severed. Internet payments are Nonrefundable.
B. Internet Access- WorldConnX has no control over the content of computers on the Internet. We make no guarantees for accuracy, reliability, decency or legality of the information you access through the Internet. We are also not responsible for temporary loss of access or any loss or damage, which may incur due to such loss of connection to the Internet.
C. User Responsibilities - User is responsible for compatibility of user's equipment and software to our equipment and software. User agrees to abide by the rules of WorldConnX, some of which are listed below:
Do not use our system for anything that might be illegal. - Material accessible to you through WorldConnX service may be subject to protection under the United States or other copyright laws, or laws protecting trademarks, trade secrets or proprietary information. Except as expressly permitted by the owner of such rights, you must not use the WorldConnX service in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material which you access or receive through the WorldConnX service. If you use a domain name in connection with the WorldConnX Web Hosting service or similar service, you must not use that domain name in violation of the trademark, service mark, or similar rights of any third party. You must use the WorldConnX service only strictly in accordance with all federal, state, and local laws, ordinances, and regulations. You may not use WorldConnX service to assist any other person or entity to violate any federal, state, or local laws, ordinances, or regulations.
Respect the security of our system. - You must not use WorldConnX service in a manner that will disrupt third parties' use or enjoyment of the WorldConnX service or other communications services and outlets, or use the WorldConnX service to invade the privacy of third parties; impersonate WorldConnX personnel; or post material on any bulletin board or newsgroup that is off-topic according to the charter or other public statement of that bulletin board or newsgroup. - You must not use WorldConnX service to solicit other members to patronize competing services, not to violate or tamper with the security of the WorldConnX service or attempt to utilize another member's account name or personal information without authorization from that member.
User is responsible for all use of his or her account. Your storage space and bandwidth utilization on WorldConnX service must remain within the storage space and bandwidth allocations associated with the access plan you have selected. For persona dial up accounts, WorldConnX will provide 10 megabytes of electronic mail storage for you, and you are responsible for ensuring that electronic mail stored by you will not exceed this limit. Additional storage space and bandwidth may be available at an additional charge. Please contact WorldConnX if you are interested. - If you publish any Web page or site using the WorldConnX service, the usage of that Web page or site should be consistent with the access plan you have chosen. For dial up accounts, your web site may receive 1G of download traffic per month. Any amount over 1G in any one month would require you to pay an additional fee of $5/G, obtain your own domain and subscribe to one of WorldConnX Web Hosting plans or WorldConnX may suspend or terminate access to your Web page or site. Through the WorldConnX service, you may have access to search engines, subscription Web services, chat areas, bulletin boards, Web pages, or other services that promulgate rules, guidelines or agreements to govern their use. You must adhere to any such rules, guidelines, or agreements. In addition, if you use any software or data in connection with or through the WorldConnX service, you must use that software or data in accordance with any application license agreement. Dial up access to the WorldConnX service is intended for periodic, active use of electronic mail, newsgroups, file transfers via FTP, Internet relay chat, interactive games and browsing of the World Wide Web. You must not use the WorldConnX service to operate server programs, including, but not limited to mail servers, IRC servers, ftp servers or Web servers. You must not use dial up access to the WorldConnX service on a standby or inactive basis in order to maintain a connection. Automated electronic or mechanical processes employed to maintain a constant connection such as use of an auto-dialer, persistent checking of email or pinging the host are prohibited. If you desire a constant connection, WorldConnX high-speed broadband wireless may be available in your area. Please contact WorldConnX if you are interested. WorldConnX traps spam and viruses. This is limited to incoming emails from your WorldConnX account. It does not cover messages from outside services such as Hotmail, Yahoo, or other mail services. It also does not cover messages and/or attachments received through chat programs such as MSN Messenger or ICQ.
We retain final editorial control of the content on our server. - Through WorldConnX Internet Service, you may have access to chat rooms, bulletin boards, Web pages, email, or other services that enable you to send or post materials (Content) and make that content available to others. You must not submit, publish, or display on the WorldConnX service any defamatory, inaccurate, abusive, obscene, infringing, or threatening content, or content that violates any federal, state, or local law. You are solely responsible for the content you make available to others through WorldConnX service. WorldConnX is not obligated to monitor the WorldConnX service to examine the content available through it. You hereby acknowledge that if WorldConnX is made aware of content that WorldConnX deems in its sole discretion to be unacceptable, undesirable, offensive, indecent, obscene, excessively violent or otherwise objectionable, WorldConnX has the right, but not the obligation, to edit, remove or deny access to such content.
Do not send unsolicited electronic mail. - You must not use the WorldConnX service, WorldConnX's equipment or any WorldConnX electronic mail address in connection with the sending of the same or substantially similar unsolicited electronic mail message, whether commercial or not, to more than one recipient. The prohibition extends to the sending of unsolicited mass mailings from another service which in any way implicates the use of the WorldConnX service, WorldConnX's equipment or any WorldConnX electronic mail address.
Violation of any of the above will result in termination of service.
D. Privacy- We will endeavor to keep your electronic mail private, viewable only by you and the person to whom you address it, however, electronic mail is not to be considered secure. As system operators, if we believe certain electronic mail is connected with illegal activities, we may disclose it to the authorities to protect our system, ourselves and other users.
E. Limits or Liability and Indemnity- you agree that we will not be responsible to you for any indirect, consequential, special or punitive damages or losses you may incur in connection with our system or any of the data or other materials transmitted though or residing on our system, even if we have been advised of the possibility of such damage or loss. In addition, you agree to defend and indemnity us and hold us harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, cost and expenses (including reasonable attorney's fees) relating to any acts by you or materials or information transmitted by you in connection with our system leading wholly or partially to claims against us or our system by others users or third parties.
F. Entire Agreement- This agreement is the entire understanding between the User and The Byte Shoppe Computer Center for the provisions of Internet services. In the event any provision of this agreement shall be determined to be unenforceable by a court or agency of competent jurisdiction, then the remaining provisions shall continue with full force and effect.
G. Governing Law - This agreement shall be governed by and interpreted under the laws of the State of Pennsylvania.
H. Cancellation - Service will continue to be billed until statement of desire to cancel is received.
